Right, Joe, but the college of cardinals or the Congregation for the Doctrine of the faith are the ones who make that decision (that the seat is empty). They have not done so.

do you mean the one that Ratzinger runs? Congregation for the Destruction of the Faith? actually I don't think that from the standard sedevacantist postion their are any cardinals left as only a true pope can create a Cardinal.

But what does this mean? Certainly, from the RC perspective, no one is higher than a Pope when it comes to matters of doctrine and discipline, and so a Pope really isn't accountable to anyone but God. As far as the CDF is concerned, it is a curial office; it does not have any jurisdiction of its own, all of its authority is delegated to it by the Pope. Hence, it (like most curial offices) is meaningless apart from the Pope. The College of Cardinals doesn't have any authority over a Pope either. They have the right to elect a Pope once one resigns or dies, and the right to govern the Church during an interregnum, but they cannot do anything to a validly, licitly elected Pope.
